Article 1 - Definitions
"Website" means the website accessible at www.payplug.com.
"User" (or "Visitor") means any person who consults the Website via a compatible terminal and an Internet connection "Payplug" means the co-editors of the Website, together or, depending on the context, separately, as identified on the page https://www.payplug.com/legal/
Article 2 - General
The purpose of the Website is to provide information on Payplug services. Browsing the Website is subject to the regulations in force and conditions of use set out below.
Payplug endeavours to ensure that the information published on the Website is accurate and up-to-date. Payplug reserves the right to correct the content of the Website at any time and without notice. Payplug cannot guarantee that the content is complete or that it has not been modified by a third party (intrusion, virus). Furthermore, Payplug declines all responsibility in the event of errors, inaccuracies or omissions in this information, as well as in the event of interruption or non-availability of the Website. Payplug undertakes to make every effort to ensure that access to, consultation of and use of the Website are secure in accordance with the rules of Internet usage. However, Payplug does not guarantee that the Website will be accessible without interruption. In this respect, Payplug reserves the right to interrupt access to the Website at any time, in particular for maintenance reasons or any emergency. Generally speaking, the User accepts the characteristics and limits of the Internet, and recognises in particular that it is up to him/her to take all necessary measures to ensure that the technical characteristics of his/her terminal allow him/her to consult the content. Similarly, it is up to the User to take all necessary precautions and all necessary steps to protect his/her terminal from any contamination or intrusion by malicious software (viruses, etc.) circulating on the Internet.
Article 3 - Intellectual property
The Website constitutes a work protected in France by the provisions of the Intellectual Property Code and, abroad, by the international conventions in force on copyright. In this respect, it is reminded that Payplug holds the intellectual property rights or the rights of use to all elements accessible on the Website, in particular the texts, images, graphics, logos, icons, sounds and software. Payplug grants the User the right to reproduce all or part of the content of the Website for storage for the purposes of representation on a single screen and reproduction, in one copy, for backup or printing on paper. This right is granted for strictly personal, private and non-collective use. Any networking, redistribution or total or partial marketing of this content to third parties, in any form whatsoever, is strictly forbidden. Notwithstanding the reproduction and storage rights as strictly defined above, and without prior written authorisation from Payplug, the User is prohibited from reproducing and/or using the trademarks and logos present on the Website, as well as from modifying, copying, translating, reproducing, selling, publishing, exploiting and disseminating in a digital or other format, all or part of the information, texts, images and data present on this Website. For all intents and purposes, it is recalled that the violation of one of the copyrights of a work constitutes an offence of counterfeiting punishable by three (3) years imprisonment and a fine of three hundred thousand (300,000) euros, in accordance with the provisions of Article L.335-2 of the Intellectual Property Code.
Article 4 - Hyperlinks
Payplug cannot be held responsible for any hypertext links to third-party websites that may be set up within the pages of the Website. The User may not set up a hypertext link to the Website without the prior written authorisation of Payplug.
Article 5 - Limitation of liability
Payplug cannot be held responsible for direct and indirect damage caused to the User's equipment when accessing the Website, and resulting in particular from the use of equipment that does not meet the specifications indicated in these general conditions of use, or from the occurrence of a malfunction or incompatibility. Payplug may not be held responsible for any indirect damage resulting from the use of the Website.
Article 6 - Governing law and jurisdiction
Any dispute in connection with the use of the Website is subject to French law. Exclusive jurisdiction is given to the competent courts of Paris, within the limits permitted by the applicable laws and regulations.
